Terms of Service

Last updated October 14, 2026

These terms are an agreement between you and Synthemo, a sole proprietorship based in California, USA (“Synthemo”, “we”, “us”), for your use of Fluxion at app.synthemo.com (the “Service”). By creating an account or using the Service you agree to them. If you don't agree, please don't use the Service.

1. The Service

Fluxion lets you make images, video, music and stories with AI models, and edit what you make. Most models are run by third parties (for example Replicate, OpenAI and ElevenLabs) and some on infrastructure we operate. We add, change and retire models and features over time.

2. Your account

  • You must be at least 13 to use the Service. If you are under 18, a parent or guardian must agree to these terms for you. Paid plans are for adults only.
  • Keep your sign-in secure. You are responsible for what happens under your account.
  • Give accurate information and keep it up to date, including your billing details.

3. Credits

  • Generations cost credits. The price of each run is shown before you start it.
  • Each plan gives a monthly credit allowance. A paid plan's renews on its billing date each month (a yearly plan's, each month from the day its year began); the Free plan's (50,000 a month) renews at the start of each calendar month and also has a daily cap.
  • On Pro and Ultra, credits you don't use roll over to the next month, up to one month's allowance. Each month's new credits are spent first. Rolled-over credits end when your paid plan ends. The Free plan's credits don't roll over.
  • When a run fails or makes less than it was charged for, the difference goes back to your credits.
  • Credits have no cash value, can't be transferred or sold, and aren't refunded as money except as described under Cancellation and refunds.

4. Paid plans, billing and renewal

  • Pro and Ultra are subscriptions billed monthly or yearly, at the prices on our pricing page at the time you subscribe, plus any applicable taxes. Yearly plans are paid up front; their credits still arrive monthly.
  • Your plan renews automatically at the end of each billing period, and we charge your payment method for the next period, until you cancel.
  • Payments are processed by Stripe. For some purchases, Stripe's Link acts as the reseller (the merchant of record) and its terms also apply to the payment; your receipt says which.
  • You can switch plans or billing period in Manage billing. Moving to a dearer plan takes effect at once and is charged pro rata for the rest of the period; other changes are reflected on your next bill.
  • If a payment fails we'll retry it for a while and keep your plan meanwhile; if it still fails, your account returns to the Free plan.
  • If we change a plan's price, we'll tell you at least 30 days before it applies to you, and you can cancel before then.

5. Cancellation and refunds

  • You can cancel any time in Manage billing on the pricing page. Your plan stays active until the end of the period you've paid for, then your account moves to the Free plan. You won't be charged again.
  • If a plan isn't right for you, ask for a refund within 14 days of your first payment for that plan. If you've used less than 10% of that period's credits, we'll refund the payment in full and end the plan.
  • Charges made in error, such as a duplicate payment, are always refunded.
  • Otherwise, payments aren't refunded for part of a period, and unused credits aren't refunded.
  • Nothing here limits any right to a refund you have under the law where you live.
  • To ask for a refund, write to support@synthemo.com from your account's email address.

6. Acceptable use

Don't use the Service to make, upload or share anything that:

  • sexualizes minors, or depicts real people in sexual or intimate situations without their consent;
  • impersonates or misrepresents a real person, or is designed to deceive (for example fake news or fraud);
  • harasses, threatens or promotes hatred or violence against people;
  • infringes someone else's copyright, trademark, privacy or publicity rights;
  • breaks the law, or breaks the usage rules of the model providers the Service relies on.

Also don't try to get around our limits or safety filters, access other people's accounts or data, overload or reverse-engineer the Service, or resell it. Model providers' safety filters may refuse a request; when they do, the credits for it are returned.

7. What you make

  • You own what you create with the Service, to the extent the law allows, and the material you upload remains yours.
  • You give us a limited license to store, process and display your content only to run the Service for you (for example to show your gallery and run your renders). We don't use your content to train AI models.
  • AI output can be similar to what others make, and may not be protected by copyright everywhere. You are responsible for how you use it.
  • The Service itself, its software and design belong to us or our licensors.

8. Third-party services

The Service relies on third parties, including model providers, Stripe for payments and Clerk for sign-in. We aren't responsible for their outages or their outputs. How your data is shared with them is described in our Privacy Policy.

9. Disclaimers

The Service is provided “as is” and “as available”. AI output can be wrong, unexpected or unsuitable, and we don't promise the Service will be uninterrupted or error-free. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

11. Indemnity

You agree to cover our reasonable costs if a claim is brought against us because of your content or your breach of these terms or the law.

12. Suspension and termination

  • You can stop using the Service and ask us to delete your account at any time. Cancel any paid plan first.
  • We may suspend or close an account that breaks these terms or puts the Service or others at risk. If we close an account without cause, we'll refund the unused part of any prepaid period.

13. Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new terms.

14. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in California, unless the law where you live gives you the right to bring them elsewhere.
